Official Contest Rules



a) To be eligible to enter the Heart and Stroke Foundation of Canada™ (the “Sponsor”) Healthy Fashion; Healthy Kitchen Apron Contest (the “Contest”) the entrant must be: (i) a legal resident of Canada; and (ii) enrolled in a fashion design school located in Canada at the time of entry (each a “School”). Employees, immediate family members of employees and persons domiciled with employees or immediate family members of the Sponsor or an entity affiliated with the Sponsor are not eligible to participate in the Contest. In these Rules, "immediate family" means husband or wife, father, mother, brothers, sisters, sons and daughters. This Contest is void where prohibited by law.

b) Entrants who do not meet the age of majority in their province must have their parent, guardian or legal representative sign the application form in order to be eligible to participate.

c) The Sponsor reserves all rights and has the sole discretion to disqualify an Entry that it believes does not conform to the spirit of the Contest.  In addition to any other requirement contained herein, the Entry must not contain any material that is libellous, defamatory, profane, violates any third party intellectual property rights, including, but not limited to, copyrights, or is obscene, all as determined by the Sponsor in its sole discretion.


The Contest begins at 9:00 a.m. Eastern Standard Time ("EST") on February 4, 2013 and closes at 4:00 p.m. EST on February 8, 2013 (the "Entry Deadline"). No purchase is necessary to enter the Contest. To enter the Contest, follow these steps:
a) Complete, sign and date the Application Form and send a copy of it to the Heart and Stroke Foundation of Canada via email at [email protected]  (each, an “Entry”). To be eligible, Entries must be received no later than 4:00 p.m. EST on the Entry Deadline. Entries not received by the Entry Deadline will be rejected.
Entries received shall be deemed to be submitted by the holder of the e-mail account. All Entries become the property of the Sponsor and will not be returned. Entries will only be accepted via email. Illegible, incomplete, late, garbled or inappropriate Entries will be disqualified. No Entries will be accepted by any other means, including but not limited to regular postal mail. There is a limit of one Entry per person. Multiple attempts at entering the Contest will render void all Entries submitted by the individual.

b) Once you have received an email confirming you have been successfully entered into the contest, you will then:
(i) Design and decorate a full-body apron (bib & skirt) (the “Apron”) that includes the following elements:
 Theme: Healthy Fashion; Healthy Kitchen
 Colour: The design must only include red, white or black colours, or any combination of the three. No other colours may be used.
 Branding: Neither your apron nor your design may include: (i) any reproductions of any of the Sponsor’s intellectual property marks, including but not limited to the HealthCheck™ logo and The Heart Truth™ logo; (ii) any other commercial logos or symbols.
(ii) Include a written description with your entry (no more than 100 words) explaining how your design represents women and heart health. Your written description must include your full name, email address, telephone number and what School you are enrolled in.

(iii) At the applicant’s expense, mail your apron and written description to the following address, to be received no later than 4:00 p.m. on April 8, 2013 (the “Submission Deadline”):

The Sponsor will not be held responsible for any errors in labelling or packages lost in the mail.  All Aprons become the property of the Sponsor and will not be returned. Aprons submitted that are inappropriate or that do not meet the requirements as set out in section 2(b)(i)(ii) and (iii) of these Rules, as determined by the Sponsor in its sole discretion, will be disqualified. There is a submission limit of one Apron per person. Any individual who sends multiple Aprons for consideration will be disqualified from the Contest.  Any Aprons received after the Submission Deadline will not be eligible for consideration.

(c) Within 7 days of the Submission Deadline, the Sponsor will post individual pictures of all eligible Aprons on:
a. the Sponsor’s campaign designated Facebook page;
b. the Sponsor’s Pinterest board ;
c. at; and
d. through other consumer communications channels at the Sponsor’s sole discretion.
The pictures will be posted for as long as the Sponsor, in their sole discretion, deems necessary.

a) Winners will be selected, from all qualifying Aprons, by a Sponsor volunteer panel. There are three prizes to be won, one in each of the following categories:  (i) most creative use of theme and materials; (ii) most original design; and (iii) best representation of women’s heart health (each a “Selected Apron”). Judging criteria will include, but shall not be limited to, the following design elements of each Apron (i) overall design aesthetic, (ii) representation of women’s heart health, (iii) functionality; and (iv) overall design creativity. The three prizes to be won will be awarded on or around May 27, 2013 (the “Selection Date”). Odds of winning are dependent upon the number of eligible Entries received. Prizes are not transferable or convertible to cash and must be accepted as awarded. 

b) THE WINNERS WILL BE NOTIFIED BY PHONE or E-MAIL AND MUST RESPOND WITHIN 5 BUSINESS DAYS OF NOTIFICATION. The Sponsor will contact selected winners via the contact details provided in each of their respective Entries. Upon notification, the selected winner must respond by telephone to the contact number provided in the notification within 5 business days of receiving notification. If the selected winner does not respond in accordance with the Rules or the selected winner does not comply with the Rules, he/she will be disqualified, will not be eligible to receive their prize,  and the Sponsor will have the right to select another Entry as a winner. The Sponsor is not responsible for the failure, for any reason whatsoever, of any selected winner to receive notification, or for Sponsor to receive selected winner's response. The prizes will be delivered by mail to the addresses provided by each of the selected winners in their Entry within 14 days of the Selection Date.

c) Before being declared a winner, each selected entrant will be required to:

a. Correctly answer a mathematical skill testing question at such time and location as agreed to by the Sponsor and the Entrant; and
b. Sign an agreement and release confirming compliance with the Rules and acceptance of the prize as offered and (i) releasing the Sponsor and its affiliates, employees directors, officers, suppliers, agents, and administrators from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest or participating in any Contest-related activity or the acceptance, use or misuse of any prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (ii) granting Sponsor the unrestricted right, in their sole discretion, to publish, without any further compensation, the name, picture, portrait, likeness, voice and ideas of that entrant for advertising and promotional purposes. The agreement and release must be returned within 5 business days of the notification date indicated on the documents or the selected entrant will be disqualified and the prize forfeited.
There are three prizes to be won (each, a “Prize”). Each Prize will consist of a grocery gift card in the amount of $100.  All Prizes must be accepted as awarded and cannot be transferred, substituted or redeemed for cash. The Sponsor reserves the right, in its sole discretion, to substitute a Prize or a component of a Prize with a prize or component, as the case may be, of equal or greater value should all or part of a Prize become unavailable for any reason.

The Sponsor reserves the non-exclusive right to publish a photograph of your Apron in any promotional material or to use your Apron as a give-away in the upcoming Heart and Stroke Foundation of Canada’s Facebook contest for women’s heart health, or in any other campaign, as determined by the Sponsor in its sole discretion.  By participating and submitting an Entry into this contest, you grant the Sponsor a non-exclusive and royalty-free right and licence (but not the obligation), in perpetuity throughout the world, to use, reproduce, and store your Apron and to use, reproduce, and store, transmit, and communicate photographs of your Apron, in whole or in part, in any media, in marketing, advertising or promotional materials, advertisements, or Web sites, by the Sponsor,  its licensees, successors or assigns, and/or for the purpose of promoting your Apron and its submission to the Contest. You irrevocably waive any and all so-called "moral rights" in connection with your Apron in favour of the Sponsor, its licensees, successors and assigns. You grant these rights and this waiver to the Sponsor free of charge. If you are selected as a winner, by accepting a prize you agree to grant the Sponsor the above licence to use your Apron and/or a photograph of your Apron on a non-exclusive basis. All Aprons submitted shall become property of the Sponsor and shall not be returned.
By entering the Contest, entrant: (a) releases and holds harmless the Sponsor and its respective directors, officers, employees, affiliates, suppliers, and agents from any and all liability for any claims, actions, demands, debts, duties, accounts, bonds, covenants, warranties, indemnities, contracts and liabilities of whatever nature, injuries, loss or damage of any kind to persons, including death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in this Contest, or participating in any Prize-related activity; and (b) agrees to fully indemnify the Sponsor and its directors, officers, employees, affiliates, suppliers, and agents from any and all claims by third parties without limitation, arising from entrants non-compliance with the Rules.

The Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete Entries, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an Entry). Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of Entries in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Sponsor is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any Web site, or on account of any combination of the foregoing. Sponsor is not responsible for any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right, at their sole discretion but subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Quebec, to cancel, terminate, modify or suspend the Contest.

By entering this Contest, entrants agree to: (i) be bound by these Rules, which will be posted at throughout the Contest; (ii) be bound by the decisions of the judges, which shall be final and binding in all respects; and (iii) the publication, reproduction and any other use of his/her first name, city or town of residence, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement worldwide carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.  The Sponsor reserves the right, in their sole discretion, to disqualify any Entrant it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest, the Contest Web site, or any Sponsor web site; (b) violating the Rules; (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (d) submitting an inappropriately designed Apron that does not adhere to the Sponsor’s fundamental principles.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

In the event of a dispute regarding who submitted an online entry, the Entry will be deemed submitted by the authorized account holder of the e-mail address, submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Selected entrants may be requested to provide the Sponsor with proof that they are the authorized account holder of an e-mail address associated with the winning entry.

By entering the Contest, each entrant expressly consents to: (1) the collection, use and disclosure by the Sponsor, its agents and representatives of the entrant’s personal information for the purposes of administering the Contest and awarding the prizes, if any, including but not limited to releasing the name of a winner; and (b) to the Sponsor’s use of their name, likeness, and statements in any activities defined by the Sponsor without compensation. All collection, use, or disclosure by the Sponsor of the entrant’s personal information shall be in accordance with the Sponsor’s applicable privacy legislation and Privacy Policy.

Subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Quebec, Sponsor reserves the right to amend or terminate all or any portion of this Contest at any time for any reason without prior notice.

12. LAWS:
a) These are the official Rules. This Contest is subject to all federal, provincial and municipal laws and regulations within each entrant’s province. These Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. This Contest is void where prohibited by law. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all Entrants without right of appeal.

b) If any term within these Rules is deemed to be illegal, invalid or otherwise unenforceable by a court of law for any reason, the affected term shall be deleted from these Rules and the remaining terms shall continue in full force and effect.

c) In Québec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
